    Default Lien for Medical Bills Against Our Home

    My question involves real estate located in the State of: New York

    First post, hope to get a direction to go in.

    We had a child in 2008 and it was an emergency c section where a neonatologist was called in. We had no choice in the matter. Our child is doing very well today. The Dr was out of network and we were told to pay the deductible of $550. We disputed the claim because of the emergency nature. In 2009 we got a letter from our insurance provider that stated that the Dr accepted the insurance payment. In 2010 we got another letter stating that we were liable for the $550? Not sure what changed? We tried to work it out with the Dr but they refused and sent us to collections and an attorney. I made a written offer and they refused. That was the last I heard.

    We are currently trying to refinance and noticed a lien. Can they do that without giving us a day in court or without officially notifying us?

    I think I read that I could post a bond with the county clerk to satisfy the refinance while I dispute the lien, but I still don't know how to dispute the claim.

    Somewhere in there was also a court hearing you apparently ignored. You have little option but to pay the judgement to get the lien released. Your chance to protest the $550 is long past. I highly suspect you misunderstood what you were told. The provider accepting a lower fee doesn't make the deductible go away.

    I was never notified of a court hearing. I was working with the collections agency the whole time then they suddenly stopped communicating.

    I called my local county clerk today and they said that they do not have a lien listed on my property. Maybe it is just something that the credit report picked up? My bank said it shouldn't hold up the closing. I still wish I had my day in court to present my case.
