    But, are there rules against Triple posting? You see, these forums are obviously a public use site, since anyone who is a 'patron' of the site can sign up and post....and his use of this site in no way restricts others ability......lol j/k

    I am sorry for posting more than one thread. If I knew how to delete the others I would. But if i can ask another question of you -

    Family law code 3024 states (paraphrasing) I can not move our children without notifying the mother unless a prior written agreement exists right? Well the amendment to the custody order says "father" can move but states nothing about "children". Is that a problem? Do I have to do this all over again?

    And to make things more complicated, what if the other parent is a drug user, with a tendency to move biweekly, and a past cps case where we lost our children and I have sole custody of them now? Would a judge bar me from moving? Could she be granted unsupervised visitation during vacation time. I am willing to supply video chat, but that certainly will not be enough for her....sigh. I have no money for lawyers.

    I think the smartest thing you can do is to notify her of the move, (in writing CRRR). If she wants to try to stop it, she can take it to court. (but I doubt she will prevail even if she does do that.)

    I don't really understand the point of that amendment, you could always have moved you didn't need an amendment to say that, the only thing restricted is moving the child. If you could quote the 'full' language of that amendment, without names or addresses, it maybe part of a larger paragraph that better explains it. That may help us better understand.

    But, even if, with the full language, if it does translate to, "Father can move with child", i agree with mmmagique, it's still best to give your ex and possibly her lawyer, notice ahead of time. It will help establish a 'time frame' and satisfy any notification provision a judge thinks you Should have had. I don't really agree that it is doubtful she will prevail, if she IS exercising her visitation regularly, the courts are hesitant to take a child away from an active parent.
