My Ex and Children Live with a Fugitive

My question involves a child custody case from the State of: Utah where my children live currently and I live in the state of Oregon. My ex met a guy and moved the kids out of the state of Oregon in April 2012 to live with this guy. In my local paper they printed a mugshot of this guy who is wanted on felony warrants. We are going through a divorce right now is there anything I can do to address the court with my kids living with a fugitive? Thank you.

First, are you absolutely positive its the same guy and not just someone with a similar name?

Yes I'm 100% positive it's the same man. Mutual friends even brought it to my exes attention but she said it was old stuff. I called the sheriffs office and they confirmed he is wanted on the charges and they are current.

Ok..then what kind of charges are they, specifically?...and how long ago was he charged? I am trying to get enough information to hazard a guess as to which direction you should go with this.

Probation violation for first-degree theft, unauthorized use of a motor vehicle and driving under the influence of intoxicants. The newspaper doesn't give the dates of the incidents should I call the sheriffs office and get those dates? Also, my ex is seeking sole legal custody of our joint children.

The only thing I can see being an issue for Mom is the DUI - and even then, it isn't too difficult to have a court order changed so that he cannot transport the children.

Other than that? I don't think you have a case for anything else.

You could call their local police and provide the warrant info.
