    Default What Happens When You Get Caught Stealing

    My question involves criminal law for the state of: NY
    I was wondering what happened to any one who got caught shoplifting or price tag switching. When no police were called. You had to fill out and sign forms, give information, and have your picture taken.
    I understand it's common for a civil demand letter
    But for a small infraction of under $40, did anyone receive a court summons in the mail and later get a criminal record, when no police were originally called? Namely at say, century 21

    If you did get a summons how long until you got it? And if you didn't get one, have you had any issues with criminal checks or someone finding out about the incident?

    The store may have entered you into the National Retail Theft Database, if they participate. So yes, other retailers can find out if you apply for a retail job and they search.

    You will get a Civil Demand. Pay it!

    The store does have 1-2 years (varies by state) to press charges.

    But how often do they press charges when no police come originally. And would say a medical board be able to tell when you have a moral and character assessment?

    That's hard to say - we're not psychic. But if you don't pay the Civil Demand, they might get a little mad and press charges.

    Medical board....I have no idea. I mean, I've had to file for Food Stamps and tried for Disability and had to do 3 psych exams, well...there's no excuse for shoplifting, but I was trying to get kicked out of the house (if I had just left, I could have faced Elder Abandonment charges, if she kicked me out, nope....).

    If they didn't call the police when it happened, there is virtually no chance that the police will ever get involved. No, there is never going to be a public record of the matter unless, as Pandora mentioned, they enter you into the National Retail Theft Database. Again, though, that seems unlikely if they did not call the police.

    Does anyone know of someone who was later summoned in the mail? Or someone who worked in store security and how the process for reporting an incident works after the fact works. Do they automatically send everything? Or would they have to personally call the police
