    Default Will Support be Lower if You Take a Lower-Paid Job

    My question involves a marriage in the state of: New York
    Is alimony figured on present income or a income history? Can a spouse take a much lower paying job to pay less support?

    If a spouse voluntarily and unnecessarily takes a lower paying job to avoid paying as much support, a judge is likely to see right through that. If a spouse gets laid off and takes whatever job they can find in order to keep paying the bills, that is another story.

    He has had several opportunities to take high paying jobs and chose not to.

    If you can prove that, then you will likely be able to have him imputed with a higher income.

    There is a difference between quitting a higher paying job to reduce your income, and not taking a job offer for a job that might pay more than your historic wage. Sometimes there are good reasons not to take a different job, even at a higher wage, including job stability, hours and working conditions.
