My question involves landlord-tenant law in the State of: Wisconsin
Hi, I am a landlord and had worked with a property management company to lease my house about 10 months ago. They found our tenants and these tenants had signed a lease for 12 months. At the end of 10 months (last month) the tenants said they were moving out but they were fine with paying the additional 2 months left on the lease if we are not able to rent it out. This part is okay, and not the issue.
We therefore contacted the property management company to help re-rent the property. They quickly found another tenant and without reviewing the listing, application, or the new lease, we trusted them to have taken care of everything (yes, our mistake). I will add that we asked for documentation multiple times but they were unresponsive and said it was all fine. They said these new tenants passed the background check with "flying colors" which upon review of their background check is fine.
The new tenants moved in about three days ago and therefore we have been pushing more for the documentation. Upon receipt of the application and background check, we noticed the rent amount was still at the previous $1,200 whereas we had specifically requested for an increase to $1,300.
We therefore requested the property management company to immediately inform the tenants and update the amount of the rent. The property management company responded and said we must re-rent it at the same price because it is during a lease break. Is this correct?? Is there any way for us to still lease for $1,300?
Some other facts:
We never signed a new lease agreement.
We never signed another contract with the property management company to find the new tenants.
