    Default Filing a False Insurance Claim

    My question involves criminal law for the state of: California
    Three counts of penal code section 550 filing a false insurance claim to obtain money from insurance.
    What may be my consequences and penalty for my first offense? I am really scared!! What are my odds? How much jail time am I facing? Did not receive any money from the insurance highway patrol released my car. It's my first offense and I'm really scared. Anyone know any information or any advice. Please, no rude comments I learned my mistake.

    scroll down to section (c)(1) and on. There are a variety of levels involved in the crime.

    I saw a couple places it listed 2.3. or 5 years in prison and up to a $50k in fines. I do not know the sentencing guidelines that may allow for any particular sentence.

    Penalty will depend in part on the quality of lawyer you are able to afford and his negotiating skills with the prosecuting attorney. It would be extremely unlikely to get a maximum sentence unless the facts of the case were particularly egregious or the amount of money involve was extremely high. If you didn't actually get money, there won't be restitution but there will be a fine. Talk to your attorney about jail time and probation. If you can hire your own, you'll be much better off than if you have to rely on an overworked public defender.
