    Default Threat to Exercise Second Amendment Rights

    My question involves criminal law for the state of:

    Arizona

    I 'am a state licenced contractor and was working on a project.There were no problems.When I submitted a invoice I recieved a written statement from client that stated that I was lucky that she did not exersize
    her second amendment rights against a subcontractor I had working on her property for being in her yard even though we had been working there for three months.The letter was addressed to me.The customer has sent this letter to the state contractors board as well as other state agencys.Would I be able to file any type of charge against her with the police dept,since I have a copy of the letter.I was thinking of getting a restraining order for protection and harrasment.Any feedback would be helpful.

    Before I comment further, I have to ask:

    Did the letter actually threaten your physical wellbeing?

    If not, you have no case for anything at all. Customers are allowed to get pissy, and they're certainly allowed to express their displeasure.

    If you even tried to take this to court you'd be laughed at before it even got in front of a judge.

    No...no they didn't.




    I'm wondering what the 2nd amendment has to do with this at all since:

    1. there is no mention of an arm (gun/weapon)
    2. a private citizen cannot infringe upon your 2nd amend rights.

    but other than that, apparently the customer was PO'd about something. Care to elaborate?




    in addition, you cannot threaten somebody with your 2nd amendment rights. You can threaten them with a gun but that has nothing to do with her rights.

    @jk- that's also the way I read it on first reading. But on second reading it becomes clearer. Customer did not say OP infringed on her right to bear arms but said OP should be glad she didn't use them. Veiled threat? I dunno. Probably best to just to take the money and run.

    Ya, I got that too. That is why the updated section.





    beyond that, in itself, that is not actually a threat. She said:

    I was lucky that she did not exersize
    her second amendment rights against a subcontractor

    she said this to a person that was not even a party to the conversation. So, even if you want to see it as anything, it was the customer telling the contractor; you are lucky I didn't shoot your employee. Do you see that as a threat? To me, it is a statement that for whatever reason the customer is all pissed off, the contractor is lucky (and I have no idea why anybody would think that makes the contractor lucky) she didn't shoot the employee. She is discussing a time in the past where apparently she felt she had a right to express herself with a bit o' lead and powder but she did not do it.

    That is not a threat no matter how you want to stretch it.
