    Default Regaining Custody After Change Necessitated by Severe Injury

    My question involves a child custody case from the State of: Florida

    I have been divorced from the father of my 13 year old son since 2009 and for 3years thereafter he has lived with me. I was the primary residency. In 2012 my son and I were involved in a bad car accident caused by a tire blowout on a major highway. We both sustained several injuries, my son was the worst ( broken arm, shattered shoulder blade, needed a major surgery to restore his arm). At that time my ex played mister Nice guy and offered to take care of our son while I got back on my feet financially and physically. I also needed physical therapy etc to restore my body.
    During this time he brainwashed my son to stay with him forever and went ahead and removed our son's main residency from me and child support. He first took away child support to which I cannot object as he has been taking care of our son for the last year. But at the same token my son secretly shared with me that his father is always at the whim of his new wife and her daughter. He also told me he doesn't have his own bathroom. They live in a 3 bdrm. Apartment with both bathrooms located in other bedrooms, leaving my son to have to use his step-sisters toilet by always knocking on her door and asking for permission. I speak to my son everyday and see him on weekends. I have a a condo with 2 bdrms and my son has a room of his own, it's quiet here and scandals, fights or noise. He sounds and acts very depressed and has shared with me that he feels alienated and imprisoned. There are frequent fights at the house and my son's needs are not being met. I asked him if he could move back with me and he answered ' Mom I just don't want any problems!'
    He is 13, turning 14 in January.
    We are currently in the middle of the process of changing our son's residency status to his father's home ( my ex filed a Petition to modify residency and judge ordered a Mediation. What can I do to stop this process and how to get my son back to live with me?

    All you can really do at this point is to contest dad's changing residency to himself.

    However mom, I am nearly positive that your son is fibbing to you about the bathroom issue. Apartments simply are not designed that way. There is always one bathroom that has a hall access even if it also has access to one of the bedrooms.
