    Default Problems With Our Neighbor and His Barking Dog

    My question involves criminal law for the state of: California. Moved in "new home" 3 years ago. First week our only neighbor, 60 years old at the time, began to ask personal questions such as who drive which car and on and on ....... At the end of first week, at night, while we were putting up our house I heard something hit against the house from the outside window area. I ran outside and caught the neighbor running away the best he could. He was listening to us through the closed window and must of lost his footing. We live in the mountains. Because of this we stopped socializing with them (his girlfriend lives with him). He has a small dog and has a retractable line connected to the dogs leash. He lets the dog defecate and urinate on our property. We asked him to stop and all he would do was shake his head yes. His still continues to let his dog on our property, and do the deed right in front of our face. This has been going on for almost 3 years now. They make the dog bark every time we go outside. When they both go they leave the dog in an inclosed patio and the dog barks non stop. We can also hear them say "sickem" to the dog and it barks horribly at us. We called the proper authorities and they told us they will send us the form to fill out. After they receive the form they will notify them of a complaint and that if it is substantiated there will be a fine. (We need a video we were told, not the pictures we had of the dog problems as they happened. We were told the judge here likes video by the sheriff authority I spoke to.) To the day I called,the neighbors stopped the dog from barking. He was a sheriff for 10 years, 30 years ago. He throws that around a lot. He had dog trouble (another dog attacked his dog) so he has had contact with these people before. I never filled out the paperwork. They must have called him because of the "camaraderie" aspect of law enforcement. Now we have nails all over our rock drive. We just purchased two motorcycles and then he has to put nails in our drive. We know he did this but did not see him do it. We need help. What are our options. He wants us to get hurt and continues to let his dog do his business on our property.

    Its the human that lets the dog on the property via the retractable dog collar

    I doubt he will be dragging him past some anti dog measures.

    Take videos and photos of everything. Last night was Devil's Night and since my car has been egged and the mailbox taken out with a baseball bat...I set my camcorder up in the window.....
