    Default Defenses to an Expired License Citation with Missing Information

    My question involves a traffic ticket from the state of: Washington

    I received a Traffic Infraction on my windshield for "Expired Vehicle License". The car is normally parked in my driveway but was moved temporarily to the front of my house to allow access to my garage.

    I want to contest the Infraction based on these points:

    1. The box for "Photo ID Matched" was checked YES. (...how can that be when I wasn't even present to show photo ID?)

    2. In the box for Violations/Statute Code, there's an illegible 10 digit number, but no RCW for me to research. (...don't I have the right to know what law I've violated?)

    Do you think these errors are substantial enough to contest and have this infraction dismissed? Thank-you....

    You could certainly appeal and make those arguments. They can correct or modify simple errors.

    Jeez, there's been a lot of posts lately for WA traffic violations. Must be the weather

    It should be pretty easy to google "washington expired vehicle license law" if you want to know more about what law you violated. Your state has a very nice user friendly site that accesses state code and google should have the link to it. I suspect that since your car was parked on a public roadway you got nailed for it.

    What's on the ticket doesn't matter. What matters is the complaint that will be sworn out by the cop if you decide to go to trial. They can correct any minor errors between now and then.

    I agree that you need to find out what law you have been accused of breaking. If it was a law dealing with operation of a vehicle with expired tags then you might have a case if you can convince a judge that you pushed the car onto the street temporarily. If merely being parked on the street with expired tags is illegal, then you'll need to look for exceptions to the law and see if any apply (temporary parking, car being repaired, moved out to street to tow to storage, etc.)
