    Default If Your Adult Child Uses Your Insurance Do You Guarantee Payment of the Balance

    My question involves collection proceedings in the State of: Illinois
    My wifes insurance provides insurance for my daughter until she is 25. She had an emergency room visit at age 22. Our insurance covered all but $1500.00. The hospital lawyer is saying that her being an adult is irrelovent that we owe for her bill because by provding insurance we accept responsibilty of payment for her services used at the hospital. She was an adult (22) at time services were rendered and she signed herself in and out of the hospital. My wife and myself did not sign anything for her visit. Can we be held responsible for her bill?

    Unless you signed something accepting responsibility at the time that she checked into the hospital, you are not legally liable for her bills. The fact that she is on your insurance doesn't make you liable.

    However...that doesn't mean that the attorney won't try to con you into paying or even file suit against you hoping that you will no show and default, and get stuck with the bill.

    unless your adult child is handicapped such that you are still her guardians, they lied to you..

    Thank you everyone for your help, I had insisted on a judgement because it was our 4th trip to court, but instead they requested trial and the judge granted them the trial. Have a nice day and thanks again everyone.

    Good call.......They can try to get you to pay but you are not liable for the medical bill.
