    Default How Does a New Child Affect the NCP's Child Support Obligation

    My question involves child support in the State of: New Mexico

    Some background: My ex has been ordered to pay child support to me for our son, but hasn't done so other than two occasions: once, when she was ordered to bring a check to court (it bounced, so I guess that doesn't count ) and the second time, when CSED garnished her paycheck (she quit before she could be garnished again). She has been working "under the table" in various jobs for the last year and a half in what appears to be an attempt to avoid paying child support. CSED has requested an Order to Show Cause hearing which will happen next week. A few days ago, I found out that she's pregnant. Can anyone tell me how this will impact the order to pay child support for our son? Will she be given leniency? Will they not expect her to work? She's basically told me that she cannot work now, because she's pregnant, but I know many women who worked up until just before their children were born (including my wife), so I'm hoping that this will not play in her favor. I appreciate any feedback. Thanks!

    It won't. You're expected to take care of the children already here before you go make more.

    An expanded family creates a potential defense to a subsequent motion to increase child support, but nothing in your state's statutes or support formula guidelines suggests that it forms a basis for reducing an existing order.

    I worked full time during my pregnancy with my daughter, literally right until my water broke - it broke at work, and she was born the next day. And I had an extremely difficult pregnancy with her, too. When I was pregnant with my second child, my son, I worked full time and took college classes part time, right up until a week before my due date. I worked full time during my third pregnancy too, until that one ended in a miscarriage (not work related).

    There's no reason a woman can't work during pregnancy, barring any major complications requiring bed rest.
