My question involves unemployment benefits for the state of: New York

I was denied UI benefits for ostensibly one unexplained absence.

I worked in the same full-time hotel job for 10 years with absolutely no absenteeism and a clean record otherwise. In August I had agreed to reduce my full-time schedule to part-time due to stress of ongoing childcare. I ended up falling into a dispute with the employer over this schedule change: firstly I assumed I would be consulted on WHEN I would be put on part time (they did it immediately) and secondly WHAT days-shifts I would work, etc,... There was no meeting and I was never consulted about anything regarding my new schedule, which was conflicting with childcare.

I brought this to the attention of my manager immediately, and we both tentatively agreed to halt all my hours over the weekend until we could arrange a meeting about it (I saw no reason to continue working terms I had not agreed upon). As the time came and past I did not hear from them so I called in a week later to be informed I was terminated for one unexcused absence. I was shocked. I argued with the manager about our previous week's phone conversation where I was sure he agreed with me to halt my hours over that weekend until a meeting was held; but he insisted that I had agreed to continue working until the dispute was resolved (pure nonsense). I explained obviously I did not show up for a scheduled day because I assumed he had removed that workday; I also added I had never been absent in 10 years of work and felt that was very unfair. I pointed out they had not called me the following day to inform me of being fired which was just puzzling, and he basically had no explanation for this ... It was all very fishy misunderstanding.

After filing for UI the case worker called me, and told me the employer's version of the incident at that time was I "quit without notice" which simply was not true. However when I received the UI denial form it clearly states termination as cause of separation: a) my "alleged" version of an understanding I had the weekend off, and b) the employer's denial of that agreement, c) and I was "terminated" due to misconduct for not calling-in after failing to show up for work on one date. UI denied.

I guess my question is whether I have a case to dispute this UI denial with unemployment? Given it's basically my word against my employer's word about what was said the week before; perhaps my phone record that I had called them the week before is about it. The fact that I had no prior absenteeism does not even seem to be at issue, nor a reduction of hours (which admittedly I had agreed to.. but not consulted on changes). The UI denial seems to hinge on the fact that I still didn't show up or call in on said date in question.
