    Entering the US on visitor visa for the purpose of immigration. There are USCIS rules in the application of law, which no one else here seems to have ever researched. It should not affect the marriage. It will very likely result in denial of his petition to enter as your spouse later. If you wish to not have that happen, marry in Canada, the Bahamas or Mexico.

    You asked about marrying in Boston, so you got an answer about Boston. You can investigate for yourself the marriage license requirements of other jurisdictions.

    Tourists marry in the U.S. with considerable frequency. Some states generate considerable tourist revenue as venues for destination weddings. As you were told, complications only arise if your fiancé plans on overstaying his visa, but as he does not intend to do so there's nothing in immigration law that would interfere with your plan. It boils down to the destination state's rules for obtaining a marriage license.

    The reason no one has "researched" U.S. laws that would prohibit somebody from marrying in the U.S., leaving the nation without going out of status, then later seeking to immigrate based upon their marriage to a LPR or citizen is that no such laws exist.

    Mr.Knowitall Ok-ok...i think the situation now more clear as we just want to marry and when his visa will be finished to move to Portugal. And what do i need to know for safe my Green Card ?

    As no one is electing to address the violation and future green card which is where I said the issue can come up, I suggest you consult an immigration attorney prior to a US marriage as I am not going to post the relevant immigration law for future reference of others attempting a similar tactic. I will however post a relevant link from a well recognized source, advising just as I am, how bad a choice what you are attempting is. He will not be able to obtain a US green card with any ease, when you decide to change your mind and live in the US later.

    Dogmatique, For me not important where to live (if be honest) because i will marry for the person who i love , not for a country ! i would be happy if he would want to stay here ,but he doesn't want so we made this decision together plus it is a lot of work for me to leave my place , friends and move all my stuff over there ....but we can't live on 2 countries. Only question - how to safe my green card ? it is still good for 3 more years ?!

    maybe not so moot after all. OP also wants to save her green card status...

    To the OP- if your intent is to move to Portugal then that implies you'll be giving up permanent US residency. You can't have it both ways. Travel outside the US is allowed on a green card within certain limits that may affect your residency status. You should talk to an immigration attorney. And if you've been here 10 years maybe you should consider becoming a US citizen. That's probably best done before you marry and leave the country.
