    Default Shooting the Other Driver in a Road Range Incident

    My question involves criminal law for the state of: Georgia

    A man began riding my bumper, so close to where I could not see his headlights. Im assuming its because I drive a "fast and furious" looking Mazda RX8. I sped up to over 90mph for a while, and slowed down to 25mph...the man never left my bumper. I tried to flag him into a gas station, he turned his blinker on and started to pull in but didnt, he took off instead. So I followed him and he wound up pulling into his driveway and got out of the car. I stopped in the road, never got out, never took my seatbelt off. I said "Whats your problem mother fu**er?" Then he fired 2 shots into the air. At that moment I pulled my gun from under my seat and put it in my lap and said, "Its okay, I have one too." Then he started firing at me, hitting my car and coming only 1ft away from hitting me in the head. When I felt the glass from my windshield hit me, I put my arm out the window and started blind firing then drove off, not knowing if I hit anything. Turns out, I hit him one time in the hip, hit his car too, and his house. I am 22 years old with no law trouble except a speeding ticket and reckless driving. From what I hear, he is 47 years old with prior gang affiliation and a criminal record. Although I could have let him go at the gas station and I could have drove off when he shot in the air, I still see it as self defense on my part when he started firing directly at me. Like I said, I have no criminal record, this is my first time offense. I just ask and pray that I will not serve jail time. Any thoughts, advice or information? Thank you!

    You need an attorney. Your situation is far beyond the scope of an internet forum.

    However...what in the heck were you thinking?...why the HECK did you even follow him?

    I called an attorney yesterday before having any charges, but now its the weekend and after having read the paper, Im freaking out.

    And I can't answer your question with a good answer because I dont have one. I have no idea why I followed him again after the gas station. You never expect someone to start shooting at you, you know? He knew I wasnt stupid enough to get out and go in his yard, and I knew he wasnt stupid enough to walk up to me not knowing what I may have had. So I was expecting a verbal argument, not getting shot at. Especially where I live, stuff like that never happens

    It took me all of fifteen seconds to find an article about this incident, using Google. As you were told when you registered and when you posted your thread, you should not post details that will identify you. I will guarantee that your lawyer won't want you posting more information to this thread.

    Odds are, you followed him because you had a gun and it made you feel invincible ("I knew he wasn't stupid enough to walk up to me not knowing what I may have had"). Blind firing in a residential neighborhood? You still could have driven away. You didn't have to put everybody in the neighborhood at risk.

    YOU created the incident that effectively forced you to defend yourself. I doubt that you will find it easy to make an argument for self defense given the scenario that you have laid out. Ouch!

    In fact, I'd say that the other guy has a better argument for self defense ... YOU followed him to HIS house, ,he fires rounds into the air to scare you away, you brandish a weapon at him making what he will say were threats, he feels scared for himself and his family and fires at the armed man who pointed a gun at him and you return fire hitting him. Yeah, you need an attorney.

    At least most of his life is over. You have trashed the rest of yours. According to the news (TH), you will soon be charged with aggravated assault which is good for 1 - 20.

    Hmm...your story does not quite match what the police are saying. You are in deep trouble. Expect a visit to arrest you soon. Say nothing without a lawyer present.

    You'd also better hope they don't hear about this post. It's called evidence and it ain't in your favor.

    Yeah, I think you'll get off because you were wearing your seat belt, lol.

    Your first mistake was assuming someone envied your car. As the saying goes, pride cometh before a fall. It would be just as easy to assume the other driver had reason to be somewhere in a timely manner. When you get out of jail and find yourself in a similar situation again, let the other person pass when it's safe, as a simple matter of courtesy. And by all means continue to wear your seat belt!
