    Default Can You Be Charged With Shoplifting if the Police Are Only Notified by Phone

    My question involves criminal law for the state of:Washington

    My friend and i were caught stealing from wal-mart in Washington state today. We had about 100$ worth of stuff between the both of us and once we walked out the door they grab us and took us to the back and we gave them the stuff back. They asked for are ids and SS Cards and for a mailing address. They told us we would have to pay for the items that had been un-boxed also said we would be receiving a bill in the mail in 2-4 weeks for the stuff we took and a court date when ever the court sends us the paper. The cops were called and they told them are info and that we shoplifted form there store. But they didn't come and arrested us. After they called the cops they took profile pictures and pictures of are cars and told us that we were suspended from all wal-marts for life. I turned 18 about 2 months ago and I'm on juvenile probation, ive been on it for about 7 months i get off Nov 6th, Im pretty sure my court date will be after im off probation. the only thing ive been charged with was a gross misdemeanor. I can't remember what it was called, But other then that my record is clean

    "This is my FIRST offence as an adult."

    Anything on this would be helpful.

    Yes, they can charge you. Retail theft is a crime. That you are currently on probation for whatever reason cannot be helpful. Don't bet that your probation officer will remain unaware of it. Honestly, what were you thinking?

    Of course they can charge you. Whyever would you think otherwise? What kind of special snowflake do you think you are, anyway, that you think you're somehow exempt from following the laws?

    Too bad that you and your friend are not in Michigan. This state would be charging with you Organized Retail Theft also!

    I read noting in the OP's post that would qualify under Michigan's Organized Retail Theft law.

    Here's a short excerpt of the law: "The new law, which defines ORC as "theft of merchandise with the intent or purpose of reselling, distributing, or transferring the stolen retail merchandise to another retail merchant or to any other person personally, through the mail, or through any electronic medium, including the internet, in exchange for anything of value," also makes the crime a felony." - courtesy of SIW
