    Default Texting Lewd Pictures

    My question involves criminal law for the state of: New York

    My brother and his ex-girlfriend have a child together (7 year old). I was skeptical of her from the beginning and I was right. Unfortunately it's easier to see from the outside looking in. She has custody and my brother pays child support. Doesn't matter that she's a wacko and an unfit mother, the guy always loses. My brother is definitely one of the good guys getting screwed.
    About a month ago she approaches my brother with I broke up with my boyfriend and she wants to reconcile, get married and all that garbage. I told my brother think long and hard and if you do at least you won't have to pat child support.
    Turns out she didn't break up with her boyfriend. What her motive was I have no clue. (I did say she's a wacko). My brother's son mentioned something about the boyfriend, my brother calls boyfriend who says they didn't break up and that's how he found out. Whatever else transpired that day resulted in an order of protection against my brother from his ex-girlfriend. My brother was adamant that he did nothing and I believed him. It was true and order was dropped.

    That brings me to today. My brother tells me he has another crazy story. Turns out this boyfriend has been texting my brother lewd pictures of his ex-girlfriend's private parts, one of him doing her in the ass, pictures of him with my brother's son, one picture of my brother's son on his bed in a blanket. Another text saying that my brother and his ex-girlfriend are both bad people and that he takes care of my brother's son. I didn't get to see or read the text messages but I told my brother go to the precinct ASAP and get an order of protection and/or call your lawyer. It's time to turn the tables. He called his lawyer and will be meeting tomorrow.

    What king of charges can be filed against this person?

    I'm going out on a limb here - your definition of "unfit" won't match the legal definition.

    With regards to the rest, your brother will find out soon enough.

    With regards to you, it's not your legal business.

    Don't go out on a limb. If she was "unfit" as defined by the court she wouldn't have custody.

    My brother will find out soon enough because I told him to go the precinct and report the incidence and to call a lawyer.

    What was your point of replying if all you were going to do is reply in a seemingly vitriolic manner.

    actually, not seeing anything necessarily actionable by your brother. It is not illegal, necessarily, to send the pics. It does not appear your brother told him to stop sending the pics either. Not sure what the pics involving the child are but as long as the nudity is not with the child present, it would appear there is nothing improper about the pics of the kid.

    That was exactly my point. You are calling her unfit - she's obviously NOT unfit.

    No vitriol. Just truth. It's not your problem, it's not your legal matter. And believe me, overstepping your boundaries could actually hurt your brother.
