    Default Accrued Vacation Pay Denied for Quitting Without Two Weeks Notice

    My question involves workers compensation law for the state of: Connecticut

    I started working a year and 3 months ago at my current place of employment. I interviewed for another job a couple of weeks ago because my manager told me that he was not sure of my employment here because of how slow business has been. Another gentleman that I work with is getting hired at the same company I just got a job at that I start on Wednesday of this week. We both gave 1 weeks notice (last week). I had asked him if he would be able to get his accrued vacation pay and he told me that our HR dept. said that we wouldn't get anything since we did not give two -weeks notice. I did check out employee handbook and I indeed did sign off on it (stating that i read the whole thing). Am I still entitled to get the vacation and sick pay?

    No. While CT law requires an employer to follow their handbook, it does not require that either vacation or sick pay be paid at termination. If your handbook says that you have to give two weeks notice in order to have unused vacation paid out and you did not do so, nothing in either Federal or CT law will require your employer to pay it.

    FYI, I am not aware of any states that require the payout of unused sick time.
