    Default Holiday Pay in Massachusetts

    My question involves employment and labor law for the state of: Massachusetts

    I have a question about working on holidays in Massachusetts. I know Massachusetts differs from other states in their laws regarding holidays. I work at a child care center and although we are closed to children on both Columbus Day and Veterans Day we are required to attend a full day of training on each of these days. Out of curiosity because I have been working here for several years I am wondering if we are suppose to be working before 12 on these days and if we should be getting time and a half instead of regular pay.

    Nope, the automatic time and a half for holidays only applies to retail. Non-retail workers get normal pay (unless the holiday is a Sunday or their number of hours puts them into overtime).

    And in addition, an employer can get a local permit allowing them to work all day. Although I am off today (I work for a university) I know plenty of people working for private employers who are working today, all day, and who are not being paid holiday pay, and it's quite legal.

    I work in retail and paid hourly. I worked 51 hours the week of veterans day. I got paid 40 hours straight pay 11 hours OT. Shouldn't I have been paid 11 hours OT /8hours holiday/32 regular pay? I questioned it and the payroll mgr said that veterans days is seperate even though I worked it.

    Veteran's day is only a holiday until 1 PM.
    I don't believe they are required to pay the premium twice (i.e., the holiday ours can be the same hours they gave you overtime for).
