    Default Roommate will not pay rent

    My roommate and I had a heated argument on October 15 that ended up in her assaulting me physically. Since that date she moved out. We signed a lease on Sept. 23 and she said she was going to pay but she did not. The lease is on both our names. She already picked up some of her stuff. And she purchased a loft that will be ready between February and April next year. She moved out to her mother's house.

    I am trying to change bills to my name but companies requires her to be the one to call. So I am carrying with bills and rent while she is paying nothing.

    Is she responsible for the lease until I find a sub-leasee?

    I do not want her in here, but landlord said the only way to stop her having access to the apartment is by issuing a protection order against her. I am considering to do so, but I need to know if she is liable for the rent until the lease expires.

    Evict the bad person under your state's landlord tenant laws.

    Unless I am mistaken you could sue her for her portion of rent up until time you find new roommate. Have proof you sought new roommate (like ad etc)

    I am basically in the same problem right here. I am taking it as far as a can. Technically when you sign a lease, you owe the ENTIRE lease to the apt. Just because they allow you to pay it monthly does not mean a thing. So if you go ahead and pay their half (like I did) and they move out and continue to not pay rent, then you TECHNICALLY have the ability to sue for the entire amount of the rent. In my case I am planning to sue for 3700 dollars. He has already paid 2 months so I have subtracted that out of what he owes the apartment complex. As far as I know I am not leaving anything out that would prevent me from collecting the full amount.
