My question involves real estate located in the State of: California
My neighbor had two old tractors that are same year, make and model. The better one is red and the other yellow. Earlier this year i purchased the red tractor for $500 cash and for which i received a notarized bill of sale that describes the tractor w/ color along with the serial number on the tractor frame. There is no title to this tractor. Neighbor did not have a problem with me leaving it where its been sitting for years, she basically needed money. Recently another neighbor who she doesnt associate with sent one of his workers (thrid party) to her house and offered to buy the tractor for $200. She agreed to sell him the yellow tractor and took the money from the worker and gave hime a bill of sale (not notarized) and does not describe the tractor but the receipt she wrote includes a clause that the deal this guy would disk her field 6 times. The neighbor whom she doesnt associate with took the red tractor (mine) and placed it on his property by the road.
When I seen my tractor in front of his house, i went to my neighbor. She said he took the wrong tractor, and she said she never spoke to him directly, the whole deal was through his worker. When i questioned the worker, he said it wasnt his problem and he is staying out of it. I told him it is his problem and he needs to go to his boss and tell him he took the wrong tractor, which he did. His boss said, "dont do anything, just wait" I dont want to wait, so i talked to the guy who has my tractor and told him i have a notarized bill of sale that pre-dates his receipt, and i told him he took the wrong tractor. He showed me his receipt that clearly shows the words "red in color" were added to the receipt later and his receipt isnt notarized. He told me he has possession of it and he wasnt going to let me have it.
I want to get the sheriff or highway patrolman to go there with me so i can get my tractor. The lady will back me up but what are my legal rights without taking it to court?
