    Default Can I Modify My Court Order Back to My Son's Birth Year

    My question involves child support in the State of: California

    I live in California. My son was born in 1996, however I, nor the state of California was able to serve my son's father with the court papers for support until 2003 because he was able to avoid getting served all those years by hiding and not working. I want to go back and ask for the judge to modify my order to retro it back to 1996 because I dont understand why my son's father should not be responsible for supporting his child from 1996-2003 just because he was smart and able to hide. He was still my son's father during this time. Can you please let me know if this is even possible? I cant find anything relating to this on the Dept of Child Support website.

    Also, my son's father is now married to a woman who is basically supporting him. If I were to ask for an increase in support will they take her income into consideration since she is supporting him? He does not work full time even though he is capable.
