    Default Possible Foreclosure, Landlord Won't Accept Rent

    My question involves landlord-tenant law in the State of: CT

    I hope this the right place to post my concerns.....

    My landlord stopped by today and gave us our security deposit back, and stated the house MAY be going into foreclosure and until it's sorted out to NOT pay him rent because he can no longer afford to keep up maintanace on the house.

    The landlord is very nice and has always been honest, but now we're in a strange position.

    We have a lease until May of next year. Should we bank our rent each month and try to stick it out until May ? If it does go into foreclosure I don't want the lender to think we have been refusing to pay rent.

    I have no problem paying the rent to the bank/lender upon request. Will this hurt my credit score (my landlord is independent) ?

    Any insight would be much appreciated.

    It does not appear he has that choice.

    Connecticut State and Local Law on Rent Withholding, Repair-and-Deduct, and Landlord Retaliation

    For state law on rent withholding, see Conn. Gen. Stat. Ann. §§ 47a-14a to-14h.

    For state law on repair and deduct, see Conn. Gen. Stat. Ann. § 47a-13.

    For state law prohibiting landlord retaliation, see Conn. Gen. Stat. §§ 47a-20, 47a-33

    Thanks for all the help !! One more question to expand upon my circumstances... If I leave well enough alone and the LL doesn't Issue a "pay rent or quit" notice (assuming he really is trying to be nice), can I still be served an eviction notice for failure to pay rent ?? ...even though I will gladly pay as long as we get to stay.

    One of the reasons I choose to rent is to not have to deal with this type of legal ditritus. This is very frustrating !!

    Definitely bank the rent so that you can pay it to whomever it belongs to when they ask you for it...and I agree that getting things in writing from the landlord is a good idea.

    Possibly. You should have gotten something in writing from the landlord giving you direction.

    I'll see if I can get him to put it in writing. Would it have to be notarized to be legally binding ?? Thanks again, I'll check this thread in the morning as I really need some sleep ! :-)

    That would be best and would enable you to make the decisions you need to.
