    Default What is the Statute of Limitations on Child Abuse

    My question involves child support in the State of: is there a statute of limitation on child abuse case if file in another state? the child passed away 8 years ago and the mother is wanting to file charges against the father who has remarried for over 20 years now? please someone help me with this.

    If the chlid is deceased then there is nothing mom can do. Why do you need help?

    If she is trying to say that dad actually killed the child, there is no statute of limitations on murder. Perhaps OP should clarify exactly what he/she is talking about.

    Also, its immaterial how long dad has been remarried.

    How old was the child when the abuse occurred? How old was he when he passed away? What kind of abuse are we talking about? Was the death a result of the abuse?

    A lot more information would be required before anyone could provide an answer. And if it has been more than 20 years, unless the child was forcibly raped in one of a small handful of states that have no SOL on such a crime, the SOL would have long passed.

    And, on the off chance that prosecution MIGHT still be possible, is there any proof of the abuse?
