    Default Who's Responsible for Maintaining a Retaining Wall

    My question involves real estate located in the State of: Virginia

    Our neighbor is asking us to remove the retaiting wall and put it on our side. He said the retianing wall was the boundary, but we did a survey and found out the retaiting wall actually falls on his land, few inches from the boundry line. but the retaiting wall protects our land, since we are on the high side. He's telling us we should remove it to our side, since we are benefiting it. The wall was established in 1970s when the subdivision was developed. i contacted the county and the county said we are not obligated to do anything to the retaitng wall.

    Then tell your neighbor what the county said. I would think that it would be very risky to attempt to move a retaining wall, for BOTH properties.

    We already communicate what the county said. they insist its our responsibility and the wall to be removed.

    Then let them take you to court and let a judge decide.

    You should insist that it is not. Let him sue you. If the wall is on his side of the property line it is his responsibility.

    How much of a retaining wall is this thing? Taking it down could have adverse effects for both properties. A big question is - what is wrong with your neighbor???

    Akachan,

    How high is the retaining wall from the ground level on the lower side? Also, how close is your house to it, or any other significant structures?
