    Angry When Can a Party Request Attorney Fees

    My question involves a marriage in the state of:South carolina
    I would like to kno how it is possible for my ex-husband to ask for 3000 in attorneys fees to be paid by me? He an his attorney are aware of the income I have which is so low I barely get by. How is it possible to ask this hen he could afford an attorney and I could not? What if I can not pay it?

    He's allowed to ask because he's entitled to ask for attorney fees. Whether or not he'll be successful is another question.

    If you're ordered to pay and you can't pay, you may find yourself being held in contempt.

    he can ask.

    if there is no statue that allows him to recover fees, then a motion to strike that section of the complaint is in order.

    when did he ask for these fees? if its at the beginning of the court proceedings and you did not provide an answer yet then you can file a motion to strike. if its past this point in time and you did not file a motion to strike then the court will examine the request and your objections to such payments.

    question you need to know the answer to: is there a statue statue that specifies that the fees in your kind of case are recoverable?

    Incidentally, he's not required to ask at the beginning of proceedings.
