My wife and I married in 2004. (She was living here illegally when we met. She purposely over stayed her Tourist Visa, but that was 1 year prior to us even meeting.) By marrying me, she eventually became a citizen, of course. We have 1 child about 9 yrs old.
Anyways, she got arrested for Domestic Violence early in our marriage, thus her citizenship was delayed a long time. I had the charge reduced to Disorderly Conduct. Well, she finally got Citizenship. But, then she filed Divorce!
During our recent divorce process, I have come to find out she is still legally married to a man in Philippines and never told me. (I was able to obtain certified copies of her marriage certificates, AOM, etc.) ***This means she lied all along to Immigration, (City Hall Local Marriage & Church too) where we got married by claiming she had NEVER been married, no previous annulments, etc.
In summary, my marriage is Null Void. Anyways, Bigamy is a 1st Degree Misdemeanor in Ohio where we got married (not a Felony). We live in Maryland now. She got Citizenship in Maryland.) Is bigamy a Felony for "Immigration" purposes? I know it is Fraud at minimum.
My question is: Once my marriage is declared Null Void by the local Judge, what should I do? Should I report her to Immigration? Should I also report her to City Hall where we got married, and the Church? I am concerned that my daughter would grow up without her Mom - and possible ramifications of that on a child.
The bottom line is: I want her to have some level of accountability to our country for lying. This is because we have soldiers defending our country and dying. Yet, she get citizenship illegally. Think of the poor kids who's parents died defending our country. They don't have a parent anymore.
In general, what is the best way to handle this and not be spiteful? Being spiteful will only bite me (and especially my daughter) in the butt later. Should I aggressively pursue this.... or let it go.
PS) Her attorney claims my wife "thought" her first marriage was Annuled because they never Consummated the marriage. Pretty weak argument I know.
