    Default Civil Hearing Notice from LVNV Funding

    My question involves collection proceedings in the State of: Pennsylvania

    I live in Pa and just received a "Civil Action Hearing Notice" from my local district court regarding a debt that was sold to LVNV Funding LLC. I've been researching for a local lawyer, but have yet to find one, the hearing is slated for 10/28 and was filed just last week...from what I'm researching I think I should file both a motion to dismiss based on standing(or maybe a motion for discovery?) asking the plaintiff to provide documentation both that the debt is valid and that it is owed by me, and ask the court to postpone the hearing to give the plaintiff time to respond and myself time to find a lawyer.

    Would this be the right way of going about things?

    PS if anyone is or could recommend a local lawyer to help I'd greatly appreciate it.

    You need to start by filing, in a timely manner, an answer and your affirmative defenses. I'm not sure why you don't believe that the plaintiff has standing. Normally a hearing would not be scheduled at this point in time, unless you're on one of the states that allows cases like this to be filed in small claims court.
