    Default Laid Off While 5 Months Pregnant

    My question involves labor and employment law for the state of: New Jersey.

    Hello,

    I need some good advice on my issue. I was laid off at my old company (company x) while I was 5 months pregnant. I personally think they viewed my pregnancy as a liability that's why I was included in the lay off. But anyway, I am currently collecting unemployment. I received a consulting offer to work from home (not full time just consulting) but I'm afraid that they might view my pregnancy again as an issue. I know my unemployment will stop once I start getting paid again so my question is, in case my consulting gig lets me go due to my pregnancy, would I be able to collect unemployment again through company x?

    That will depend on the stage of your pregnancy. If you are still able to work, actively looking for work and available to accept work if offered, there is no reason why you will not be able to restart your claim. If you are unable to work (and this remains true regardless of the consulting job) you will not be able to receive unemployment until you are medically cleared to work again.

    Another thing to consider is if this new employer decides to allege misconduct and puts of up a good enough argument, you might just find yourself cut off or going through months of appeals before you get paid again. Because NJ has a simple misconduct penalty, they tend to use it frequently and that means you have to wait 7 weeks before your benefits kick back in. They could also do things like put you on third shift that makes you want to quit. Again, complicating your claim.

    Why would the new employer do that? It's not going to affect his unemployment rates.
