    Default What State's Law Controls Termination of a Child Support Order

    My question involves child support in the State of: NH
    I the father was divorced in a state we will call state 1. The ex and children moved a couple years later to NH without any modifications to divorce papers which I did not object to. Later I moved out of state 1 to another state. I did a couple years ago introduce the divorce papers from original state into NH to have a modification made to allow my child to live with me for a year. No other changes were made. The child is know at the required limits for the state of NH to end child support payments. Since I introduced the divorce papers into NH as foreign documents do I follow the NH rules or still the rules of the original state we divorced in which would end at age 21?

    The answer to your question is that a court of another state CANNOT reduce the duration of your original support order

    Changing states for modification of child support orders falls under UIFSA., which every state has adopted and implemented into their own statutes.

    Under UIFSA Section 604 (and New Hampshire Statute 546-B:49 Modification of Child Support Order of Another State), while a court of another state may modify a child support order which originated in another state, it MAY NOT modify the DURATION of the order. Nor can it modify any portions of the order which would not be modifiable in the original state.

    If the original order is from a state in which child support is payable until age 21, the State of New Hampshire will not reduce that. But that works both ways.

    Thank you gator1. My ex and child at this point have lived longer in NH then state 1. It would seem at some point that would become a factor but I guess not.
