    Question Emancipation In Another State After Running Away

    My daughter is 15yo and pregnant. We are moving to NC from Florida in Dec. after she has the baby but her boyfriends wants to go with us. His mom will not allow them to get married and i know she isn't going to let him move with us so he told my daughter that if he had to he would run away to be with her. I know in NC you can leave home at 16 but not sure what florida law is. Can you please help me because i don't need any more problems than i have already?????????????????????????????

    The age of majority in North Carolina is 18, not 16. A minor may petition for emancipation at the age of 16, but has no legal right to run away from home.

    Florida's emancipation laws require a parent or legal guardian to initiate the emancipation process.

    ok I read the message saying if he resides in a county for 6 months he could file petition for emancipation. does that include the runaways. if they can take care of themselves and have been for 6 months in that state could he file for emancipation or would he have to come back down here?

    If he runs away to Florida, as previously stated, under Florida law his parents would have to initiate any emancipation proceeding. And no, running away is not a good first step toward convincing a court that you are sufficiently responsible to be emancipated.

    he wants to run away to NC not florida. he want to leave florida.

    He knows what you are asking. It's difficult to accept the answer is "there isn't a legal way" . And no one on this site would suggest an illegal solution. Maybe you have some other options rather than moving and the boy running away.

    If she is planning to parent this baby is she involved in some support/education programs (prenatal, etc)? Her focus is going to change in a few weeks. Then you intend to move? It sounds hectic.

    If the boy runs away, his parents will go to the police, and report him as a runaway, then when he goes to ask for emancipation, this comes up in the records. The judge will take one look at that, and say NO. He is better off waiting until he is 18, to come live with her, and until then, you, and your daughter, and him and his parents should be discussing child support, visitation, and future plans for the both of them.

    ok one last question. can her boyfriend do anything if his mom wont let him come visit the baby? because she wont let him come alone and doesn't want to come up there at all. can he do something about not being able to see his child?

    Why would Mother not allow him to see his child if child was brought there? He has right to see his child but with him being a minor himself he must do as his parents say. I have to say this and I mean no offense but based on what you have told us I must think there is more to this than we have been told!
