    Default How Does Emancipation Affect Insurance Coverage and Paying for College

    My question involves child support in the State of: Indiana

    I have two full time college students, 19 and 20. They moved to college last month. Father has filed to emancipate and stop child support because they do not live with me. He carries insurance. I am concerned with the new law details. How do I insure they do not lose their insurance and also that he helps with college support. There has never been an order for college support for either son. What legally are the boys entitled to?

    I can answer the questions about health insurance.

    A parent MAY continue coverage on their children up to the 26th birthday of the child. This is part of the Federal Affordable Care Act and is unaffected by custody or emancipation. However, nothing in that or any other law REQUIRES that the parent continue their health insurance coverage. If Dad chooses to do so, his employer/insurance carrier cannot prevent him from doing so as long as they are under 26. If he chooses not to do so, nothing short of a court order can compel him to do so.

    And before you ask, if there is no prior order you will NOT get one now.

    what do your orders say about support, college expenses, and medical insurance after the children turn 18?

    In other words Mom, if you didn't get an order prior to them turning 18 to cover insurance and college you're not going to get one now.

    if there was no order in place covering college age kids, in some way, why would dad be seeking to have them emancipated.




    mmoftwoboys: if there is an order in place now that he is to continue some payments, whatever they are, leaving for college is not them moving out of the family home for the purposes of emancipation consideration.

    But I'm wondering if that is not referring only to college costs and not necessarily basic support. That would explain the question of what does dad have to pay towards college and the fact he is also seeking to have the kids emancipated. Just a WAG. OP will have to fill everybody in on the facts.
