My question involves criminal law for the state of: Louisiana
I was arrested for possession of a schedule 2 narcotic and drug paraphernalia. This wasn't a routine traffic stop. I was a rear passenger in a vehicle with three other people. The paraphernalia was located on my person and the single pain medication pill that was found was on the floorboard of the vehicle. Ownership of the pill was wrongly identified as mine. Consequently I was never read my rights. Also there were no other tickets issued to anyone else in the vehicle. My question is A) I have no priors B) rights not read C) No proof as to the ownership of the drug D) No money for an atty E) No concern for paraphernalia charge F) Felony charge for possession not an option...can I fight this and beat the possession charge and plead guilty for the lesser? What recourse do I have? Also I do have a prescription for the medication in question.
