    Default Can a Landlord Who is Renting Rooms Enter Common Areas at Any Time

    My question involves landlord-tenant law in the State of: California

    The landlord is currently renting rooms out, separately, and he does not live in the home. He says that because he rents each room separately, he has the right to come over whenever he wants to and has the right to come into the common areas of the house (kitchen, living room, bathroom), and when he does come inside the home he is very loud, intrusive, and disrespectful (i.e. he called a roommate a bitch after they gave him a beer, and he told the roommate to open it. This was their first meeting. He also occasionally opens the refrigerator and drinks beverages of ours) He rents out a basement that has poor ventilation, made up of 3 very small windows that do not lock. The windows are too small for an adult to fit through and the stairwell is the only accessible way into the room. The back steps are rotted, and about to fall apart, and he's been aware of it, and I've brought it up a few times, and he does not take it serious. He also has an illegal studio in the backyard (he is licensed general contractor), and also has 2 illegal studios at the home he lives in which is 5 blocks from here. We also have no written agreements with him as of yet, but at the end of September he wants us to sign agreements.

    This is a 3 bedroom home in San Jose, California.

    Could someone give me any info or advice on how to move forward with this?

    I would just like to know what kind of options and rights I have as a tenant. I'm not very well versed in law, although I know he's doing a few things wrong.

    If the tenants believe that the premises are not properly maintained, or a bedroom is illegal, they have recourse through local housing officials.

    If they don't like the landlord's policies toward common areas, don't like his attitude, or believe he's stealing their beverages, their best bet is to consider finding a different place to live.
