    Default Do the Police Have to Show You a Warrant Before Searching Your Home

    My question involves civil rights in the State of: Ms
    I was doing dishes all of a sudden I heard someone say police. I can to the living room and seen cops at my door. I had the screen door locked. they entered my house with out a warrant. They did find weed. They took my 8 yr old son into a bed room asking where all the guns was. My wife had a 9mm luger. They cuffed me. My wife came home from work and asked what this was all about. I told her I had some weed. They cuffed her also. Took both of us to jail. No one was in the house except for the cops. The did inventory of what they had found. My wife didn't know anything about what I was doing with the weed. Well I called the cop that was in charge to ask for our stuff back. computers, cell phones. He said just look on your inventory of what we took.. I said I never got one. well 8 days later a cop shows up at our house with inventory and the search warrant. I made the cop sign it because I didn't get show it when they entered the house, or when I released from jail.

    Come on 8 days later to show someone a search warrant. Then on the discovery it didn't say nothing about my wife. Just me. Then it also said a man came up to a cop and said he knows where some weed is being sold. 2 more men went to 2 different cops and told them the same thing. Then they said they staked out my house. This was all in one day.

    The hit the house next to mine and gave him a search warrant. cops was looking for a gun.

    What should I do? Its the 4th amendment.

    If they had a warrant, they had a warrant. Even if hey didn't show it to you.

    Are you facing criminal charges? It appears you were arrested, so the assumption is that you are. So, this is something your attorney can address.

    However, the fact that you were not provided a copy of the search warrant at the time of the entry, or an inventory of items taken, does not mean that no warrant existed. Your attorney should be able to obtain this information via discovery and determine if there was a warrant issued prior to entry at all. Your attorney can make the proper motions to quash the warrant and suppress any evidence seized. However, given the fact that they were looking for marijuana and found some, that is likely to reinforce some of the claims made in the application and affidavit.

    And, you say they were at your door and the screen was locked. How did they get past the screen? Did someone let them in? Did anyone object to the search? These are all issues for your attorney.

    Is there any dispute with the receipt/inventory you received some days later? Does it reflect the items taken?
