My question involves a marriage in the state of: New York
My girlfriend of 6 months has discovered that she is pregnant with our twin babies. She has been estranged from her husband for 2 years and not seen him in that time - she kicked him out for adultery (and several other issues) and he moved to CA with his new partner. Now after 18months of him stone-walling, he is suddenly very happy to get the divorce which should go through in the next 1-2 months.
She is American, but her husband is a foreign national and on a spousal Green-card, and his lawyer has suggested that they file as "no-contest, at fault (her) for adultery" because that will help his potential immigration status and attempts to stay in the US. Whilst she would prefer a "no-contest, no fault divorce" because the clock is ticking on the births, she is willing to do this even though he committed adultery/did other things first, simply to get it done and over with. There are no (existing) children involved and no known assets to speak of (no house, car etc) excepting a cat that she currently has and will keep or give up as required. She is happy to keep what she has (including her own credit card debts) and he can keep what he has.
My question: He is apparently a somewhat sneaky individual and has a history of gambling, and she is worried at the sudden speed that he is doing things. In particular she is worried that he might have accumulated debts/issues since they last saw each other (he might have even opened things in her name - she has no idea) which she has no knowledge of but might suddenly become liable/responsible for in case of an at-fault divorce. I am trying to find info as to how possible/likely this scenario this is, or any other potential issues that she should be aware of.
Partly due to to the ticking clock she is hoping to get things finalised as quickly as possible and avoid use of courts/lawyers if at all possible (lawyers in NYC are very expensive, and with twins coming and the loss of her income for at least a few months, every dollar is increasingly precious)
