    Exclamation Caught Stealing from a Store in Utah

    My question involves criminal law for the state of: Utah.
    Alright. Well about 2 weeks ago I was at the local grocery store near my home. Well I went in and wandered around and grabbed a fountain soda and then wandered around again looking at the stores items. Then I walked out of the store. I know I shouldn't have done it. I should have payed for it. I know what I did was wrong. But as I was walking out of the store and to my car. An employee of the store came out and followed me to my car and asked me where my receipt was. I lied at first saying that I had thrown it away on my way out. He told me that I needed to come inside with him. So I did and then I admitted to stealing the soda. He called the police and they gave me a paper stating when I was to come in and see a judge. I have stolen in the past when I was 16. I never got caught. A couple weeks after I had stolen (when I was 16) I got a call from a man saying he was a police officer. He said I needed to give him a call back so he could discuses with me my retail theft. I tried to call him back but the number said that it was not an active number or whatever. So I thought nothing of it and thought maybe it was someone trying to play a prank on me. I never received a letter in the mail or a call sense then or any information on if I was being charged or not. Well I went into my court date today and I have never been charged with anything before and am not really good with the legal system. Again I am 19 and am actually 26 weeks pregnant. The judge asked me if I had been charged with anything else. I said no. Due to me not ever receiving any letters or any indication that I have. I told him I have had a couple speeding tickets but other then that no. He asked me if I wanted to talk to an attorney I said I am not sure. Just because I have no idea. I don't know what my legal rights are all I want is to get this situated and do whatever I need to do. He then asked me what was I pleading then. I said guilty just because I admit I did it and it was wrong. Then he told me that he is going to set up another court date and have me come in to talk to an attorney. I am just wondering if I will be arrested. I really don't want to go to jail. I am pregnant! Are they going to give me a fine? or make me take some classes? if you could give me any idea of what will happen that would be wonderful. thanks.

    It is unlikely that you will go to jail over the theft of a soda, unless you comport yourself like an ass in court and annoy the judge.

    Speak with your court appointed attorney, who will likely advocate for a pre-trial diversion program, in which you will take anti-shoplifting classes, pay fines, make restitution, and complete a period of probation. Such a program may result in you having no criminal record upon successful completion.

    And stop stealing. You have someone else to concern yourself with now.
