    Default Dealer Didn't Pay After Consignment Sale of a Car, Claims They Filed Bankruptcy

    My question involves bankruptcy in the state of: CA. This dealer took my car, sold it and never give me the money. I trusted her and signed the registration...When I asked for the money, the owner said she's filed for chapter 7. She told me not to bother to go after her because I will never get my money back. What should I do? Thanks for your help!

    This is either a licensed dealer, or it isn't. The dealer is either still in business, or she isn't. Fill us in.

    The car was sold how long ago?

    It sounds like we're talking about a personal bankruptcy, which would not necessarily absolve the dealer of responsibility - but the facts matter - and if it was not a "zero assets" case it may be possible for you to pursue the debt given that you weren't provided with notice of the bankruptcy filing.

    This is a licensed dealer. We purchased the vehicle from this dealer 2 years ago and paid $11k (paid off). 3 months ago, the same dealer agreed to sell our car through consignment. Mistake on my part is that I didn't have any contract signed. I trusted her and handed her the title and the vehicle. Last month, she told me that the vehicle was sold and she promised to give me the money, that never happened. She finally told me that she has filed for bankruptcy. Not only she took my money, she's now threatens my kids safety if I go after the money.

    Today, I got the chapter 7 doc that she filed. She did not include me as her creditor. This is hard earned money from working in the Navy for more than 10 years. We are desperate. Thanks again for your help!

    she had filed chapter 7 or the business has filed bankruptcy? Maybe I should ask; is there an actual business? If so, what is the business structure? I believe you can find that on California's .gov site. (can'r remember the specific site at the moment.)
