    Default Can You Get Emancipated if You Can Support Yourself With a Part-Time Job

    My question involves juvenile law in the State of: North Carolina

    Hey guys new to the forum really not looking to see rude responses. I just want help. First off I am 16, and I do not know everything about the law so please don't jump on me. Okay;

    Alright so situation at home is personal, and would make me feel better if I didn't discuss it on a public forum. I am 16 years old. I am a Junior in high school, and I have a part time job and work five days out of the week (It's decent money for 16). I can't take what I'm going through, and need help understanding the requirements for emancipation. I have a steady job, I go to school, and have plans for after school. I also have dependable transportation, and a place to stay with affordable rent, and requirements. I just want to know what the full requirement is. Please no negativity... thank you.

    The courts will look for ANY reason to deny an emancipation and with good reason.

    Your money might be okay for a 16 year old, but is it enough for you to afford market rent, utilities, food, clothing, insurance, incidentals, transportation...?

    Emancipation is not, and never was, intended to help a minor out of a bad situation at home. It is intended to provide legal protection to minors who, through no fault of their own, find themselves needing to get the power switched on in their name, get the lease transferred. Think "my parents just died in a plane crash".

    Not "I can't take it at home".

    Yes 100% I could afford all personal costs. But if DSS becomes involved could I become emancipated?

    Specially not. DSS becomes involved = your chances are even lower.

    I am curious though - how much are you earning part time to afford everything mentioned?

    And how are you earning it? Because unless your state laws are different than mine...you should be in school and at work no more than 48 hours total per week, combined. Anything you are earning "under the table" will not count as income towards emancipation. If your employer is exceeding hours for a minor....that's a big no-no.

    I make about $200 every two weeks, and I found a place that is renting a room out, and I can afford that along with buying my own food they just require I pay them for the room, and I have a portion of utilities I pay . If there is already reports to DSS what could happen? thank you guys so much for the help by the way. I am in high school and I work after school and yes I have balance. Nothing is under the table. I'm sorry i'm trying to be limited on information....

    I'm also not trying to get away from my parents because; I hate them, or "I can't take it at home".. thats not what I meant. Sorry...

    Along with my pay I have saved up enough in my bank account to get started.

    Okay, I'm sorry, but that's not going to prove to the court that you are financially self-sufficient.

    To convince the court not only do you have to be (generally) living apart from your parents to begin with, but have the ability to pay full market rent - not a room somewhere, but full market rent - utilities, clothing, insurance, food, transportation, the whole works.

    CBG puts it this way - if the person who is renting out a room sells the property or dies in a plane crash, can you afford to continue without the reduced rates? Say, in an efficiency apartment? I don't know where in NC you are currently, but you're talking about earning a take-home pay rate of least $1500/month to afford the basics alone.

    I cannot see a court emancipating you.

    No, dear, that is not even close to enough of an income for a court to consider your self-sufficient. Four times that, maybe. Even that's a stretch.

    100/wk is nowhere near enough to support yourself.

    how will you afford health insurance? what will you do if the person you want to rent from evicts you or raises the rent later?
