    Angry Do You Have to Pay Child Support for a Child That Raped His Sister

    My question involves child support in the State of: New Hampshire

    My son is in a state run facility right now, because he raped my daughter. He was originally supposed to come back into my residence once he completed his program, but I have since decided that my daughter's safety has to come first and there is no guarantee that he won't try it again, so the state has decided to place him in foster care. I just got a letter stating that they want me to pay child support for him, because he is in foster care. First off, he has a father that was paying child support for him until he was arrested and then he had a lawyer fight for him to be able to put that money in trust till my son came home (which he has not been doing). And they are only coming after me for child support now. So because my daughter lives primarily with me and I want to keep her safe (she is 8) I have to basically pay to keep her safe by paying to keep him away from her. There has got to be some way around this. Yes I understand he is my child, but he raped his sister and I have no choice, but to keep her safe.

    Help?!?!

    Why should the state support your child? Of course you must support him. Should you instead be permitted to profit by not covering the expenses of your child?

    Now it appears that your son won't be coming home. So take the matter back before the court so BOTH of you can pay child support, since you both have the burden of supporting the child, no matter whose roof he's living under. (ie request that the money in the trust be applied to support, and future payments be made to the state, rather than the trust, since it appears the state is taking him away full time)

    New here, first post....

    I agree with the post above. He is still your son & in your situation I could understand you wanted to protect your daughter by not allowing him into the home but......as said he is still YOUR SON so your responsibilities as well as his father.
    Many parents must pay support while their child is in foster care. If you go back to court his father could very well be ordered to pay support to the state instead of putting the money in the trust. You may or may not have to pay anything.
