    Default Can Parents Refuse to Support a 19-Year-Old in Mississippi

    My question involves guardianship in the State of: Mississippi



    The age of automatic emancipation in Mississippi is 21. I had to take in a 19 y/old male because his parents kicked him out due to his "lifestyle choice" (gay). They have completely cut him off financially.They sold his car, his belongings, his clothing, and everything else. All he had when he came to me was 2 outfits that he spent his last $80 on that day. It has now been over 2 months since he has had contact with his parents. Is that legal or is it child abandonment? Also for him to go back to college he must use his parents financial information for financial aid unless he is 24 y/o; or unless emancipated. The same goes for government assisted housing. He is working 2 PT jobs; but just started both and has $0 to his name. Is there any legal recourse we can take since they have abandoned their child before the age of automatic emancipation in Mississippi? any advice will help.

    He's legally an adult. The 21 age is concerning issues relating to child support. There appears to be no court ordered child support here.

    Now, there may be an avenue by which he can go to the court and ask that they support him and MAYBE 93-11-65 can apply to him ... maybe. But, that might also mean he will have to return home. Sounds like its best for him to be gone even if they do have an obligation to support him somehow.

    Of course, it appears that a court would likely consider him emancipated because of this:

    He has discontinued full-time enrollment in school having attained the age of eighteen (18) years, he has (arguably) voluntarily moved from the home of the custodial parent or guardian, established independent living arrangements, and is cohabitjng with another person without the approval of the parent obligated to pay support.

    Mom and dad are apparently under no legal requirement to support him. He is free to get a job or seek financial aid as he can. And there is a way to seek financial aid if mom and dad will not respond to the request for information as requested in FAFSA and other paperwork.

    Also, do you KNOW this young man? Do you personally KNOW the parents? As a note, I have heard many similar tales spun out here that have turned out to be complete fabrications and have been used to get close to sympathetic people and eventually run a scam on them and rip them off. So, if this kid is someone you just met and spinning a tale of woe, be VERY careful as it may not be true!

    I suspect OP is his boyfriend and does not want to support him.
