My question involves criminal law for the state of: Montana
I have been charged with Criminal Possession of Drugs (three counts).
I have been working with a public defender. We received discovery, but it was incomplete, i.e., not all information was provided. My attorney requested the missing information. The prosecuting attorney indicated that he "had an entirely different report." I was told he would provide the correct information.
I have checked in weekly to see if the corrected discovery has been supplied. It is now approximately 15 days until the trial and I have not received any new discovery.
My question is this: Doesn't the discovery have to be supplied at least 30-days (thirty-days) before the trial date? It is not supplied, then can I file a motion to dismiss the charges?
