    Default Applying for Citizenship With a History of Domestic Violence Charges

    I came to America in April of 2009 on lottery from Morocco. In April of 2014, I will be eligible to apply for citizenship. I have paid my taxes all 5 years. In August of 2012, I was arrested for Assault 2 Involving Domestic Violence. All Charges were dropped in November of 2012. I have no convictions, but I know that I will have the arrest on my record and that it can look unfavorably in my case. What should I do to ensure that this will not prevent me from getting citizenship. My fiance and I are still together and she said that she would be willing to write a statement explaining the situation. Has anyone else been arrested for domestic violence and allowed to become a citizen?

    IMO, whenever you have any criminal history (arrest for domestic violence with dropped charges included), i believe it is in the person's best interest to consult an attorney. Although dismissed charges are unlikely to be an issue, an attorney will advise you of the documentation that should be in your hand in case there are any questions. It is worth the cost of the consultation for the peace of mind knowing that you have prepared.

    On a more personal note, I hope you and your fiance have taken advantage of family counseling to minimize the chance of this occurring again.
