My question involves an easement in the state of:TX
The city as a drain pipe that discharges water onto a vacant property that I was looking into purchasing. it runs under the street from a culvert on the other side with collects the storm water runoff from uphill. It looks like it has been there a few years but not that long but has cut a fairly good size trench as it runs down hill from the front of the property to where it joins a creek at the rear of the property.
I hear some say that the City doesn't need an easement and the bigger it get the more easement they get . And I've heard other's say that a City can't discharge any storm water on someone property without an easement or else are legally responsible for the damage to the property
Anyone familiar with this topic?
