    Default Fired for a Mistake at Work While Suffering From a Medical Condition

    My question involves labor and employment law for the state of: Nevada.

    I have FMLA for migraines and I'm a blackjack dealer .

    A few days ago I was having a splitting migraine as I was working and I made a big monetary mistake. Right after my big monetary mistake, I asked to go home using my FMLA.

    On my first day back after my migraine, I was wrote up for my mistake.

    My question is can my employer still write me up if they knew the reason I made that mistake was because I had a migraine.

    FMLA allows for protected leave time. It does not protect you from screw ups at work.

    Ditto. Otherwise, you could have a migraine at will, every time a friend showed up.

    Just because the mistake was medically based doesn't mean your employer has to overlook it. Yes, your employer can legally write you up for this. Next time call out or go home earlier.
