    Default How to Add Additional Medical Conditions to FMLA Agreement

    My question involves labor and employment law for the state of Ohio.

    I have a friend that has FMLA to attend doctor visits for her husband who has cancer. She now also has cancer and needs her own appointments.

    Her employer was very specific with her stating that her FMLA only covered her husband. Can she add her own condition and needs to her FMLA?

    Her employer already is acting frustrated with her for time she's missed for her husband. Thus, she's very concerned about more time for her own visits which she definitely needs.

    Any advice would be appreciated.

    Her employer is correct. The current FMLA claim only covers her husband.

    She is free to file a second claim to cover her own visits. However, she needs to be aware that she gets a total of 12 weeks per 12 month period no matter how many claims she has. She does NOT get 12 weeks for her husband and 12 weeks for herself to total 24 weeks; she gets 12 weeks, period.

    But her first step is to complete the paperwork for herself and submit it to get her own claim going.

    To make sure I understand you completely, you're saying that one person can file multiple FMLA claims (i.e. one for family member, one for self, etc.) but the time of work is still restricted to the same total 12 weeks in a 12 month period?

    If part of this time off work is covered by PTO/vacation or short-term disability, does it also count against your FMLA allotment?

Yes. That is exactly what I'm saying. The law allows 12 weeks, period, not 12 weeks per condition. Anything above that is up to the employer.

    If part of this time off work is covered by PTO/vacation or short-term disability, does it also count against your FMLA allotment? If the employer says it does, it does. The law is very specific about this. An employer MAY allow additional time over the 12 weeks of FMLA. They are NOT obligated to do so. Whether the time is paid or unpaid does not change this.
