    Default Fast Divorce with Unwilling Wife

    My question involves a marriage in the state of: Florida
    Hello,
    I have been separated from my wife for over a year now. She has been living with her new BF for over a year now as well. She keeps telling me she will agree to a uncontested divorce but every time it comes down to doing it she comes up with some excuse why she can't or doesn't want to. We have already sold my house and divided assists, she got every thing anyway. She has one child from a previous relationship so we have no children involved. So my question is how hard and expensive would it be to hire a lawyer to get this accomplished since she will never sign the papers for me. I just want to be done with her already. Lastly she has a car that is in my name and she makes partial payments on, i have agreed to let her keep the car as long as she makes payments, but if after the divorce she stops making payments do i have any legal right to take the car back? The car is in my name only, the loan, and registration, insurance all in my name. Just trying to figure out what rights i have if any after the divorce with the car or if i'm going to be stuck making the payments myself while she keeps the car. Any recommendations on what the best, fastest way to get a divorce in a situation like this is appreciated. Also I have moved away for work, but only to a different county, still in Florida.

    May I offer a suggestion? Do NOT hand over that car unless you're actually transferring ownership and you get her to buy you out.

    We unfortunately see this all the time - one spouse is awarded a vehicle, the loan etc, are all in the other spouse's name and guess who gets stuck with a ding on their credit when the spouse stops paying?

    In this situation - you.

    Don't do it - I know you want this over quickly and just want to move on, but I'm not convinced that letting her take the car while your name is on everything is the wisest move.

    I understand that. That's why i'm here to try and find out the best and easiest way to get the case filed since she keeps dragging her feet when i try to file the simplified uncontested divorce. She is going to make me take legal action, when i was trying to do this the easiest way possible. So any suggestions i'd be happy to hear.

    Thank you, i suspected as much. So trying to get the car back and get the divorce is really not going to be easy.

    The problem with this advice is that the judge probably won't agree with it. Unless they are a one car family and there is only one car to award, a judge is going to award a car to each party.
