    Default Creating Fake Ads to Harass a Business Owner

    I don't know much about laws so I wasn't sure where to post this. Admins, feel free to move it to the appropriate place if you like.

    There is a person that has been doing everything in their power to ruin my mother's small online business. This person has a small online business in the same field but is spiteful and wants to take out the competition, even though there is enough room for everyone. This person never names names when she bad mouths my mother's business but the people know who she is talking about. She seems to be doing everything legally and even if she wasn't, I don't see how any one would benefit financially from taking it to court.

    I'm tired of my mom having no recourse for this horrible person's behavior. My idea is to put up a fake site with ads (nothing sexual) linking to her business email and phone number so that she will be bombarded with distracting phone calls and emails. Is it legal? Would the site provider have to disclose who I am if she requested it?

    This is the only thing I could think of that would cause her online business trouble, without breaking the law. If you guys know of anything better please do tell. :P

    a claim of defamation does not necessarily require a specific naming the the defamed party. If the inference is clear, that may be enough (your mileage may vary based on the specific facts of the situation)

    gotta love when a person complains about another person doing something illegal and then suggests an action that could easily get them sued and possibly facing a criminal court judge.


    do not do what you are suggesting.

    Did you eat a bowl of Stupid for breakfast, with an order of Moron on the side? What in the seven blazing Hells is WRONG with you?

    Of course it isn't. It's harassment by electronic communication, punishable by both fines AND imprisonment. Depending on the number and nature of the communications received, it could even rise to the level of cyberstalking, which carries harsher penalties.

    Would the site provider have to disclose who I am if she requested it?
    It would take her about 5 minutes to get a court order demanding disclosure of your identity.

    If your Mother's skin is so thin that this sort of competition is causing her undue stress, she may not be cut out for her business. If it's just you having a fit over someone dissing your Mama, you need to grow up fast before you find yourself a guest of the state at L' Hôtel du Greybar.
