    Default Can Foreign Nationals Divorce in the U.S.

    My question involves a marriage in the state of:England. I have two friends that are married British citizens. They now have been in the US for 6 months. They're not permanent US citizens, but do not want to go back to England. They now decided to divorce for in differences. Can they get a divorce her in the US.

    They would have to investigate the residency requirements of the state where they plan to divorce.

    Well they're in Texas. And, one lawyer said it was possible. But, just wanted other opinions on the situation

    To file for a divorce in Texas, at the time the divorce is filed, either spouse must have been living in Texas for the preceding six-month period and a resident of the county in which the suit is filed for the preceding 90-day period.*

    Well neither have citizenship there. But, one has a sister and mother that are us residents

    Reason being they can't stay in the US unless they have permission to do so - not wanting to go back to the UK is not quite going to wash.

    And since they're adults, they're not likely to get an immigrant visa any time soon (not via the family, anyway).

    And if THAT is the case, I would hazard they have more to worry about than where they get divorced.
